Presently, in Bangladesh the contravention of labor rights have become a common phenomenon. Given that our economy cannot prosper without this huge manpower. But unfortunately, different organizations most importantly the garments owner are frequently violating the laws regarding labor rights. According to, The Bangladesh Labor code 2006, section 4, “Working Hour means the time when the worker remains under the control of his employer force work excepting time for eating and resting”. This section signifies that workers will be on the hand of the proprietor except the time they consume or take rest. But, in reality the labors in different organizations do not get perfect time for eating as well as for taking rest. They endlessly work but do not get a single moment for taking rest. And it is a complete violation of labor rights. Again, In section 10 of this act sates that , “Gratuity means 30(thirty ) days wages of a worker at the rate of last drawn wages for a full year or more than six months service which he gets on conclusion of service.” while there is law but not all the circumstances in Bangladesh is applicable.
Though workers work more than the expectation of the owners, at the end they do not get their suitable rights. Consequently, According to The Bangladesh Labor code, 2006 section 45, “Wages means remuneration expressed in terms of taka or capable of being expressed in terms of taka, which whether the terms of the contract of employment are expressed or implied, are fulfilled, payable to any worker for his job or work and shall include other additional remuneration of the aforesaid nature.” seeing as this act implies that any labor or worker may get his or her payment on his work additionally any extra work he conclude. But, in practical circumstance the workers failed to achieve or get their wages which they owned. This is again the violation of this law. Likewise, this act also states that, “Any establishment may have a service rule of its own, but such rule cannot be less favorable to a worker than the provisions stipulated link with worker.” It provides that, the rules of any work cannot be unfavorable to any worker. Unfortunately in Bangladesh most of the organizations have such kind of rules which totally goes against the workers but they continue their work only for endurance.
Subsequently, this act provides that, Section 12, “Stoppage of work, The employer , at any time ,in the event of fire catastrophe, break down of machinery , stoppage of power supply , epidemic , civil commotion, or any other reason beyond his control , if necessity demands , may stop any section or sections of his establishment partly or wholly and may keep the order of stoppage in force till the reason for which the order of stoppage is given exists” with this act we can comprehend that any owner may stop the work of an organization if there happened any supervening act. excluding, in many times in Bangladesh there is happening many unfortunate acts still the owners force the employees for the continuation of their work while ethically they should make the position to stop the organization for the sake of workers life.
yet again, In this act in section 19, states that “Death benefit: if a worker during the continuous service for more than three years under any employer meets death , the employer shall pay 30 wages or gratuity whichever is greater for the service of each full year or for a period of more than six to the nominated person of the decreased worker or in absence of any nominated person to his any dependent and this amount of money will be payable in addition to the benefit payable to him on retirement.” As this section, gives the right to all the labors of Bangladesh to achieve their financial benefit but surprisingly, in our country the labors are not completely not enjoying the laws. In most of the cases the labors do not get their proper privileges to survive with a better opportunity.
To conclude, it can be said that as there are many laws provided for ensuring a better life .Regrettably, these laws are frequently violating in Bangladesh. If we want to bestow the opportunity to the labors of our country for enhanced survival all the people as well as the government of Bangladesh have to come forward to stop this violation of this law.
